He claimed that after hitting drummer Jeff Prosperie with an ax, he suffered "severe and long-term mental and physical injuries, some of which are permanent with permanent consequences of agony, impairment, deformity, and loss of body function."

During his marriage to Deering, the journalist had a child with Fox executive producer Jennifer Rauchet, with whom he had an adulterous relationship. Jennifer Cunningham, better known as Jennifer Rauchet, has served as the Fox channel's executive producer since 2006.
